FILE - This Oct. 16, 2020, file photo shows Kenneth Earl Gay, who was previously convicted of killing a Los Angeles police officer, during a retrial hearing at the Los Angeles Superior Court in San Fernando Courthouse in San Fernando, Calif. Prosecutors will re-try the case against Gay, but have not yet decided if they will seek the death penalty again. Gay, 62, is charged with murdering Los Angeles Police Officer Paul Verna in 1983. The California Supreme Court has twice overturned Gay's death penalty sentence and in February vacated his original conviction, forcing the Los Angeles County District Attorney's office to decide if it would pursue the case again.
