PROVIDENCE, R.I. (AP) - The son of a noted sculptor is asking the Rhode Island Supreme Court to overturn his child molestation conviction.
Forty-three-year-old Byron de Weldon is the son of the late sculptor Felix de Weldon, who designed the Marine Corps War Memorial at Arlington National Cemetery in Virginia. He received a suspended sentence in 2004 in a Newport child molestation case.
The Providence Journal reports (https://bit.ly/OFWMRi ) de Weldon argued Wednesday before the state Supreme Court that the conviction should be overturned because his lawyer didn’t advise him that his plea bargain could expose him to being detained in Massachusetts.
Massachusetts officials committed de Weldon as a sexually dangerous person in 2007 in connection with a 1995 indecent assault case involving a child. He remains committed at a treatment center in Bridgewater, Mass.
