Los Angeles Superior Court ruled that actress Halle Berry won’t have primary custody of her 13-year-old son, Maceo, news outlets reported.
Judge Shelley Kaufman dismissed a request for a domestic violence restraining order from Ms. Berry’s ex, actor Olivier Martinez but temporarily denied Ms. Berry’s request for 50/50 custody and overnight visits.
Mr. Martinez, 60, accused Ms. Berry, also 60, of physically abusing Maceo, citing a Sept. 26 incident in which she allegedly “attacked” the teen by “jumping on him, putting her hands around his neck, and choking him.”

That prompted Mr. Martinez to seek sole legal and physical custody.
The custody arrangement from the temporary restraining order will stay in place pending additional proceedings, leaving Ms. Berry, who denies all allegations, with joint legal custody but limited physical custody.
The couple married in July 2013 and divorced in 2023 after an eight-year legal battle, agreeing to joint custody and $8,000 a month in child support for Mr. Martinez.
Ms. Berry’s daughter, Nahla Aubry, 18, whom she shares with ex-boyfriend Gabriel Aubry, submitted a written declaration Oct. 3 calling the allegations “completely inconsistent with the mom I know” and describing her mother as “a loving and devoted parent” to her and her brother.
She continued, “At the same time, I have also witnessed occasions when Maceo has been disrespectful, at times aggressive, and unwilling to follow rules at home. When that occurred, my mom responded the same way she did with me when I was growing up: by enforcing appropriate boundaries and consequences, such as limiting screen time, imposing time-outs, or restricting access to electronics and play dates. I never observed anything abusive about her parenting.”
