WAUKEGAN, Ill. (AP) - An appeal means there will be another delay in the trial of the wife of a northern Illinois police lieutenant who killed himself and made it look like it was a line-of-duty death.
Lake County prosecutors Wednesday asked a state appellate court to overturn a judge’s decision that martial privilege protects text messages they hoped to use in their theft case against Melodie Gliniewicz (GLIHN’-uh-wihts). A Lake County judge ruled last month that the text messages between Gliniewicz and her late husband Fox Lake Police Lt. Joe Gliniewicz can’t be used at trial.
A defense attorney didn’t comment after a brief Wednesday court hearing.

Melodie Gliniewicz was indicted after her husband committed suicide in September 2015. She has pleaded not guilty to charges including siphoning money from a youth policing program.
