DAYTON, Ohio (AP) - A robbery suspect shot and wounded by police has been granted a mental evaluation as he seeks a plea of not guilty by reason of insanity.

Montgomery County court records show Charles Ashford’s attorney filed a motion Wednesday for the not-guilty plea and the evaluation. The 18-year-old Dayton man is charged with aggravated robbery and impersonating a police officer, among other counts.

Police say Ashford was shot Feb. 5 in the Dayton suburb of Miamisburg after firing a gun at police and claiming to be an FBI agent. Prosecutors said an officer saw Ashford trying to carjack people at gunpoint after he robbed a gas station and shot him after he refused to drop a gun.



A grand jury found the off-duty officer who shot Ashford acted lawfully.
