BILLINGS, Mont. (AP) - A judge has dismissed the case against a Musselshell County commissioner who was charged with filing a false police report after an angry interaction with a county resident.

Commissioners Robert Goffena and Thomas Berry were charged after reporting the citizen pushed Goffena while trying to follow commissioners into their chambers. Video of the February incident showed Goffena pushing the resident.

Berry was acquitted of the misdemeanor charge on Oct. 18 after testifying that he believed the resident had pushed Goffena and was not intentionally misleading police. Prosecutors moved to dismiss the charge against Goffena the next day.

Goffena told The Billings Gazette Tuesday that he was positive the resident pushed him. He alleged the charge was politically motivated, saying “they didn’t want me to run for re-election.”
