BILLINGS, Mont. (AP) - A central Montana county commissioner has been acquitted of making a false statement to a law enforcement officer who was investigating a reported confrontation between a citizen and another commissioner.

The Billings Gazette reports Musselshell County Commissioner Thomas Berry was acquitted of the misdemeanor charge last Thursday during a bench trial before Big Horn County Justice of the Peace Leroy Not Afraid.

Berry acknowledged his report that a citizen pushed Commissioner Robert Gofena in February did not match up with surveillance video, but he said it was what he believed happened.

Gofena’s trial on the same charge is set for next month.

Investigators said the courthouse camera video shows Gofena pushing a citizen who tried to follow the commissioners into their chambers.
