THERMOPOLIS, Wyo. (AP) - A Casper businessman was convicted of third-degree sexual assault at a retrial.
Jurors reached the verdict against Tony Cercy Wednesday morning, after a seven-day trial in Thermopolis and more than 10 hours of deliberation.
Cercy was acquitted in February of first-degree and second-degree sexual assault against a 20-year-old woman who was passed out on a sofa at his lake house in June 2017. However, jurors could not reach a verdict on the third-degree sexual assault charge, leading to the retrial.
Natrona County District Court Judge Daniel Forgey ordered Cercy be taken into custody. District Attorney Michael Blonigen says he’s not sure what sentence he will recommend. The charge carries up to 15 years in prison.
Defense attorney Jeff Pagliuca declined to comment to the Casper Star-Tribune.
