CONCORD, N.H. (AP) - A federal judge has thrown out claims in a lawsuit filed by the mother of a New Hampshire man who was fatally shot by police in 2015.

Police said 41-year-old Hagen Esty-Lennon, of Canterbury, crashed his car in Bath and staggered away with a self-inflicted knife wound to his chest. They said Haverhill officers ordered Esty-Lennon to drop a knife and shot him six times when he refused and lunged at them.

His mother, Donna Esty, filed a wrongful death lawsuit against the town and police officers. The Valley News reports U.S. Magistrate Judge Andrea Johnstone recently dismissed claims of violation of civil rights, municipal policy and unreasonable seizure, or excessive force. Johnstone also moved the case to state court.
