MITCHELL, S.D. (AP) - A sex offender who lived where his wife was operating an in-home day care in Mitchell has avoided serving immediate jail time.
The Daily Republic reports that 41-year-old Robert Brewer and 32-year-old Jamie Brewer were both sentenced last month to 90 days in jail with the time suspended and ordered to pay $100 fines. They will avoid jail if they don’t violate the terms of their sentences.
Jamie Brewer pleaded guilty to permitting a sex offender registrant to reside in an unregistered day care in her home. Court documents say Robert Brewer, a convicted sex offender, lived in the residence.

Jamie Brewer told police that she had been babysitting for friends and didn’t know it was illegal to operate a day care with her husband living in the residence.
