TULSA, Okla. (AP) - Lawyers for the Tulsa County court clerk are appealing a federal judge’s ruling that Oklahoma’s ban on gay marriage is unconstitutional.
A notice of appeal for Court Clerk Sally Howe was filed Thursday with the 10th U.S. Circuit Court of Appeals in Denver. The three-page notice did not raise any arguments.
Howe was named as a defendant in the case after she refused to issue a marriage license to a gay couple.
U.S. District Judge Terence Kern on Tuesday struck down Oklahoma’s voter-approved ban on gay marriage, but stayed the effects of his ruling anticipating an appeal.
The Denver court is also hearing an appeal in a similar case from Utah.
